The U.S. Census Bureau now requires a Shipper’s
Export Declaration (SED) for each shipment to Puerto Rico or the Virgin
Islands where an individual commodity exceeds $2500 unless otherwise exempt
from Federal regulations. Per this regulation change, a separate SED must be
filed for each shipment, with the U.S. Principal Party in Interest (USPPI)
named and identified by and Employer Identification Number (EIN). Per customs,
it is the duty of theUSPPI (the shipper) to ensure proper preparation of the
SED. It is the duty of the carrier to report the SED filing status of each
shipment to the U.S. Census Bureau. In addition, it is the carrier’s obligation
to only move and deliver shipments for which the carrier can confirm
appropriate SED filing. Previously carriers were able to prepare and file a
single document for an entire container of multiple shipments. You can get
additional information on these new regulations and determine exemptions from
SED filing at the U.S. Census Bureau website at
www.census.gov/foreign-trade/www. In addition, you can click on FORMS
to view a blank SED form.
It is the goal of the U.S. Census Bureau to reduce paperwork by having the
shipper (USPPI) file the SED through the Automated Export System (AES). AES is
a free, internet based filing system provided by the U.S. Census Bureau. To
receive certification to file via AES, access www.AESDirect.gov.
The following options and procedures have been established effective January
15,2002 to assist in proper preparation of a bill of lading to comply with
these new regulations.
1. SHIPPER ELECTRONICALLY FILES THE SED
The shipper must note on the bill of lading the declared value, and note the
AES XTN number of the filing. UPS Freight will not charge a SED preparation &
processing fee for a BOL noted in this manner. A sample BOL statement: NDR AES
(XTN)_______-__________.
2. SHIPMENT MEETS EXEMPTION CRITERIA AND SED NOT REQUIRED
If no single commodity in the shipment exceeds $2500 in value, the shipper must
note on the bill of lading the declared value of the items in the shipment, and
state that a SED not required. A sample BOL statement: NDR Value Less Than
$2500. Further, if the shipment meets exemption criteris (gift, household
goods, military, government agency) an SED is not required if so noted on the
BOL. www.census.gov provides federal regulations for exemption status. UPS Freight
will not charge a SED preparation & processing fee if exemption is noted on
the BOL.
3. SHIPPER AUTHORIZES UPS Freight TO FILE SED ON THEIR BEHALF
The shipper can authorize UPS Freight to file the SED on their behalf. For a $9.00
preparation and processing fee, UPS Freight will file the SED on the shipper’s
behalf. This written authorization must be in place prior to tendering the
shipment. The shipper must still note the declared value on the BOL, as well as
a statement like “ CARRIER TO FILE SED”.
In addition, the shipper can provide the original SED form 7525V (Yellow Paper)
for UPS Freight’s forwarding to the Census Bureau. UPS Freight will charge a $9.00
SED preparation and processing fee for this forwarding service.
